Clemency Petitions

A Petition for Clemency in Illinois is a request for the Governor look at and review a criminal conviction.  The Governor acts alone and exercises his or her own judgement in making a decision.  However, there is a panel at the Illinois Prisoner Review Board that reviews paperwork for clemency and makes recommendations to the Governor based upon its findings.   A successful presentation and Petition for Clemency vastly increases the chances of success.  Because a Clemency petition can take several years before a final ruling, it is especially important to have an experienced Illinois attorney on your side.

Here is the general procedure:  First, we request a hearing before the Illinois Prisoner Review Board.  Hearings take place every few months in Chicago and in Springfield.  At the hearing the Petitioner is sworn in before making any statements to the Prisoner Review Board.  Then, testimony in support of the Petitioner is given.  After this hearing, the Prisoner Review Board makes a recommendation to the Governor.  At this point, the Governor reviews the Petition and makes a ruling.  Since there is a great backlog of Petitions for Clemency, and the Governor rules on each Petition, it can take up to several years for a Governor to rule on a Clemency Petition.
